N.Y. Daycare Provider and Husband Sentenced to 25 Years to Life in Prison Over Fentanyl Poisoning Death of Toddler

A New York City couple has been sentenced to lengthy prison terms following a tragic case involving the death of a toddler and the poisoning of three other children at their daycare centre. Bronx Supreme Court Justice Margaret Clancy imposed a sentence of 25 years to life for Grei Mendez, aged 38, and her husband, Felix Herrera Garcia, aged 37, after they were found guilty of severe criminal charges, including second-degree murder.

The verdict was delivered on 21 November 2023, and the sentences were made public on 4 March 2024. The case revolved around the incident that occurred at Mendez’s daycare, named Divino Niño, on 15 September 2023, during which four young children suffered life-threatening effects due to exposure to fentanyl, a powerful synthetic opioid. Tragically, a 22-month-old boy, Nicholas Dominici, died as a result of the poisoning.

The Bronx District Attorney’s office revealed that among the victims was a two-year-old child who experienced respiratory arrest but fortunately survived after receiving hospital treatment. Additionally, two other children, aged two years and eight months respectively, also required urgent medical intervention for acute opioid intoxication.

Prosecutors painted a harrowing picture during the trial, revealing that substantial quantities of fentanyl had been processed at the daycare. They alleged that kitchen equipment typically used for preparing food for the children had been employed in handling this dangerous narcotic. Disturbingly, it was established that before Mendez contacted emergency services when the children fell ill, she first reached out to her husband, who subsequently removed narcotics from the premises.

Disturbing footage showed Garcia fleeing the centre shortly after the emergency occurred, carrying plastic bags that were reported to be weighted down. Law enforcement later discovered nearly a kilogram of fentanyl hidden in a closet, with an additional twelve kilos of fentanyl, heroin, and other drugs concealed beneath a trapdoor in the playroom area — a space where the children would frequently sleep and play.

“These babies were shields to protect a narcotics operation,” stated Bronx District Attorney Darcel Clark, condemning the couple’s actions. She remarked on the profound tragedy that befell a “beautiful little boy” and urged that the severity of their crimes warranted lifetime imprisonment. Clark underscored the incredible neglect exhibited by Mendez and Garcia, highlighting that the hidden fentanyl was a testament to their greed and disregard for the safety of the children in their care.

The couple also faces separate federal prison sentences totalling 45 years for drug trafficking charges resulting in Nicholas’s death, which will run concurrently with their state sentences.

Family members and advocates have expressed their outrage and sorrow following the verdict. During a press conference held soon after the announcement, relatives of the affected children spoke passionately, stressing the urgency for stricter regulations and oversight in childcare facilities to prevent such horrific incidents from occurring in the future.

As the case draws to a close, it serves as a stark reminder of the ongoing opioid crisis that has plagued communities across the United States. Public health experts continue to warn about the dangers of fentanyl and similar substances, particularly in environments where children are vulnerable.
