A 28-year-old man reportedly remains in a dire condition following an incident involving Immigration and Customs Enforcement (ICE) agents in the Bronx, New York, on 8 October 2026. Oscar Belgal was shot during a targeted enforcement operation while his five-year-old son was in the car. His legal representatives have expressed grave concerns about his health and treatment while in custody.

Currently housed in solitary confinement at the Metropolitan Detention Center in Brooklyn, Belgal has a bullet lodged in his neck. According to his lawyers from The Legal Aid Society and Make the Road New York, he is experiencing numbness on the left side of his face and has severely impaired hearing in his left ear. The lawyers stated in a public statement on 11 October that Belgal has not eaten since being taken into custody and has limited access to fresh water.

Despite being informed that he needs urgent surgery, the operation has not been scheduled due to concerns surrounding safety, as medical professionals deemed it too hazardous without specialized surgical staff being present. His attorneys claim that despite recommendations for him to return to the hospital for the necessary procedure, Belgal remains uninformed as to when this will occur.
The incident occurred during an ICE operation aimed at arresting Belgal, who has a documented criminal history, including prior arrests for grand larceny and assault. The Department of Homeland Security (DHS) stated that Belgal allegedly failed to comply with orders from ICE agents and subsequently rammed into two government vehicles before accelerating towards the officials, prompting them to discharge their firearms.
New York City Mayor Zohran Mamdani condemned the shooting, characterising it as “an unconscionable and incredibly serious situation.” He revealed that he spoke with the President to demand the cessation of ICE enforcement actions within the city. Mamdani emphasized his commitment to standing against any actions that may instil fear in local communities.
Following the shooting, the agency has faced scrutiny regarding its enforcement methods and treatment of individuals in its custody. Critics argue that the processes in place reflect a disturbing disregard for human rights and dignity, particularly evident in the treatment Belgal is reportedly experiencing while detained.
The mayor confirmed that initial reports suggest ICE agents surrounded Belgal’s vehicle before discharging multiple rounds. Fortunately, authorities indicated that his son, who was present in the car during the incident, appears to have escaped physical harm.
After the shooting, a federal judge issued a temporary stay on Belgal’s deportation and has prohibited federal authorities from relocating him outside the New York and New Jersey area without prior court approval. This development was welcomed by Belgal’s legal team, who maintain that he deserves not only medical assistance but also basic human rights.
The situation continues to develop, and advocates are mobilising to support Belgal, demanding fair treatment and adequate medical care commensurate with his rights under the law. His lawyers are committed to his immediate release from detention and are fighting for the provision of necessary medical treatment that has been denied thus far.
As investigations into the shooting progress, the case has sparked broader discussions about the practices of ICE and the implications of its enforcement actions, particularly in urban communities like New York City, where fears of federal intervention are palpable. The public awaits further updates on both Belgal’s health status and the ongoing inquiries into the incident.
