In a harrowing case that has troubled the Texas community, Tanner Horner, a former FedEx delivery driver, has admitted to the murder of seven-year-old Athena Strand. The tragic incident unfolded when Athena was playing outside her home in Wise County on 30 November 2022. Horner abducted the young girl, allegedly leading to a brutal confrontation in his delivery truck that culminated in her death.

During the sentencing trial, jurors were presented with harrowing audio evidence of Athena’s final moments, including her desperate pleas for her mother as she cried out, “I want my mama!” The shocking details of the case were highlighted in closing arguments presented to the jury, who must now decide whether to impose the death penalty or sentence Horner to life in prison without the possibility of parole.

On 7 April, Horner pleaded guilty to charges of capital murder and aggravated kidnapping, and the prosecution laid out a compelling case against him. Wise County District Attorney James Stainton focused on the violent nature of the crime, stating that Horner “beat the hell out of her” during the attack. He described the evidence, including the shoes Horner wore at the time, as emblematic of the extreme brutality inflicted on Athena, emphasising that the level of violence was a critical factor in the proceedings. Stainton contended that criminals like Horner reinforce the need for the death penalty in Texas.
In a stark contrast, the defence team attempted to humanise Horner, claiming he was suffering from various mental health issues that contributed to his actions. Defence attorney Steven Goble stressed that their decision should revolve around moral judgment, arguing that the prosecution had not definitively proven sexual assault.
The defence also argued that Horner’s panic, driven by a fear of losing his job after Athena allegedly saw him using cocaine, was a catalyst for his actions. Susan Anderson, another defence attorney, made a passionate plea for mercy, imploring jurors to sentence him to life instead of death. “You hold a man’s life in your hands… Are you going to be merciful? Or are you going to be vengeful?” she asked the jurors, urging them to consider the potential for rehabilitation.
However, the prosecution countered these claims by highlighting the absence of remorse shown by Horner following his actions. Stainton expressed disbelief that the defence could characterise Horner’s actions as anything but merciless. He asked the jurors to reflect on whether Horner exhibited any sign of compassion during the tragic incidents.
As the trial progressed, the defence rested its case after presenting a forensic psychologist who testified to Horner’s mental health diagnoses, including bipolar disorder and anxiety. Yet, the prosecution surprised the court by calling forth a rebuttal witness—Horner’s cousin—who accused him of sexual abuse during their childhood, casting further doubt on Horner’s character and alleged mental health struggles.
The courtroom bore witness to deeply troubling evidence, including video footage and audio recordings captured within Horner’s truck during the abduction. Jurors were shown a scene where Athena, visibly terrified, questioned Horner about his intentions. When asked where they were heading, he ominously responded, “It doesn’t matter,” and warned her against screaming.
The chilling recordings continued to reveal events leading up to the tragic end of Athena’s life, with sounds of struggle and despair ringing out in the courtroom. Prosecutors described Athena as having fought valiantly for her life, with her body ultimately found in a nearby creek two days post-abduction. The medical examiner confirmed that she had died from blunt force trauma and suffocation.
The community has been left in shock following this tragic event, and the courtroom proceedings have highlighted the heartbreaking reality of violence against children. The jury now faces a momentous decision that weighs heavily on both the future of Tanner Horner and the broader implications for justice in cases of such grievous nature. As they deliberate, the memory of Athena and the intense emotions surrounding her untimely death resonate profoundly throughout the state of Texas.
