Ajay Dev, a 58-year-old immigrant from Nepal who had 76 convictions, was released on his own recognizance on Friday, May 23, following the ruling. The Superior Court of California, Yolo County, has scheduled a trial setting conference and motion hearing for Friday, June 13.

The decision to overturn Dev’s lengthy sentence came after Superior Court Judge Janene Beronio raised concerns about the credibility of his accuser, his adopted daughter Sapna Dev. The judge suggested that there was substantial evidence to suggest that Sapna may have fabricated the charges against Dev in order to harm him and secure her stay in the United States.

Sapna, who was adopted from Nepal at the age of 15, alleged that Dev had sexually assaulted her multiple times a week for several years. However, during a recent hearing, four witnesses testified that Sapna had admitted to fabricating the accusations out of anger towards Dev. One witness claimed that Sapna confessed to making the false allegations as a means to return to the United States.

Judge Beronio highlighted that there was evidence indicating a positive relationship between Sapna and Dev prior to the allegations. Sapna had reportedly expressed affection and love towards Dev and his wife through cards, texts, and emails between 1999 and 2004. The judge noted that if jurors had been presented with this evidence, the outcome of the case might have been different.

Dev’s attorney, Jennifer Mouzis, emphasised his client’s clean record before the case and his good behaviour during his incarceration. Supporters of Dev, including advocacy groups, have praised Judge Beronio for taking a close look at the evidence and making a thoughtful decision in this case.

It is now up to the District Attorney’s Office to determine whether to retry Dev following the judge’s decision to overturn his sentence.
