The Punta Gorda Police Department stated that Horner was charged with burglary with assault or battery (non-forced entry) and emphasised that such behaviour would not be tolerated in their city’s waterways or anywhere else. Chief Pam Smith condemned the actions depicted in the video, asserting the commitment to ensuring the safety of residents and visitors in the area.

The video, uploaded by Gage Towles, has sparked outrage and concern, prompting law enforcement agencies such as the Florida Fish and Wildlife Conservation Commission (FWC) and the U.S. Coast Guard to initiate investigations alongside the PGPD. Scott Weinberg, an attorney representing Horner, issued a statement expressing regret for his client’s actions and acknowledging the impact of the viral video on Horner’s personal and professional life.
