Halle Berry has filed a court petition to reinstate the previous 50/50 custody arrangement for her 12-year-old son, Maceo Robert, whom she shares with ex-husband Olivier Martinez. The actress, who is currently 60 years old, has requested from the court that she regain tie-breaking authority concerning decisions about their son, along with enforcing court-ordered therapy for Martinez.

The petition comes after Martinez sought sole custody of Maceo, making serious allegations regarding Berry’s behaviour towards their son. Although Berry did not directly address these claims in her recent filing, she cited that Martinez’s resentment towards her has affected their co-parenting dynamic and impacted Maceo’s well-being.
In her court documents, Berry voiced concerns about the emotional turmoil Maceo appears to exhibit following visits to Martinez. She described how Maceo often returns from time spent with his father feeling “angry and combative,” suggesting that these feelings manifest when Martinez has custody for extended periods. Berry elaborated that it typically takes Maceo two to three days to adjust back to their home environment after returning from visits with Martinez.

Berry further alleged that Maceo seems to echo conflicts between her and Martinez. She indicated that the boy often appears to side with his father during disagreements, particularly those regarding decisions about his schooling and other activities. This tendency, she noted, undermines her parental authority, causing friction in their relationship.
In light of these disputes, Berry indicated a dire need for cooperative parenting, arguing that Martinez’s actions hinder Maceo’s educational and emotional development. She claimed that his refusal to engage with necessary interventions has worsened Maceo’s academic struggles and behavioural issues.

Additionally, Berry contended in her documents that Martinez has been dismissive of the positive influence her fiancé, Van Hunt, has on Maceo’s life. She highlighted that Martinez’s rejection of her partner has obstructed their attempts to create a harmonious family environment during joint therapy sessions.
Despite Berry’s filing, Martinez responded by asking the court to dismiss her request for reinstating joint custody. He asserted that a temporary restraining order against Berry is already in place, citing concerns regarding potential risks to Maceo’s safety. The allegations have reportedly escalated to claims that Berry has physically abused their son, with Martinez stating that Maceo reached out to him during an incident that occurred at their home.
Martinez’s filings suggest that Berry’s behaviour could pose an ongoing risk, as he contends that the situation warrants immediate action. He expressed that Maceo deserves protection and stability, requesting sole custody and a no-contact order for both himself and Maceo in relation to Berry.
The court hearings have seen a flurry of accusations from both parties. Martinez alleged that several instances of physical and emotional abuse towards both himself and Maceo have occurred, raising further alarm about Berry’s parenting capabilities. He specifically requested that Berry abstain from alcohol or any substances while caring for Maceo, suggesting that sobriety testing should be enforced.
In an initial ruling, the court modified visitation rights, limiting Berry’s time with Maceo to designated hours. This temporary ruling aimed to facilitate some level of communication until further assessments could be made regarding the custody situation.
Throughout their contentious divorce, which was finalised in 2023 after nearly eight years of marriage, both parties were ordered to share joint custody of Maceo. At that time, Berry was required to pay Martinez a monthly child support of £8,000, highlighting the ongoing financial aspect of their co-parenting responsibilities.
Berry, who also has an 18-year-old daughter from a previous relationship, has described the challenges of co-parenting with Martinez as difficult. Their past efforts to engage in therapy aimed at resolving disputes have reportedly fallen apart, as disagreements over participation heightened.
As the legal battle concerning Maceo unfolds, the focus remains on securing a stable environment for the young boy amidst the ongoing tensions between his parents. Both Berry and Martinez will likely continue to face scrutiny from the public as their custody dispute progresses through the judicial system, highlighting the often complex realities of celebrity parenting.
