A Texas mother is taking legal action against Uber and one of its drivers, claiming her experience during a ride with her two young children was both traumatic and perilous. The lawsuit was filed by Cynthia Sarabia in El Paso County District Court on April 1, 2025, detailing a series of alarming events that she alleges transpired during the journey.

Sarabia’s complaint highlights significant safety concerns, including an incident where one of her children did not have access to a functioning seatbelt. The lawsuit alleges that throughout the ride, the driver exhibited erratic behaviour, including driving at speeds of up to 90 miles per hour upon entering the Interstate 10.
The complaint outlines how Sarabia expressed her fears for her children’s safety. She repeatedly requested that the driver decrease his speed and allow them to exit the vehicle, but these pleas went unanswered. “Inside the vehicle were two minor children, improperly restrained, while the driver continued to operate at dangerous speeds,” the legal document asserts. It further claims that despite Sarabia’s continuous requests regarding speed, safety, and the vehicle’s condition, the driver took no corrective action.
A video provided by Sarabia’s attorney captures the alarming situation within the vehicle, with Sarabia urging the driver to stop the ride and leave the freeway. As tensions mounted, the driver allegedly refused to let Sarabia and her children exit until she cancelled the trip via the Uber app—even though Sarabia did not possess the necessary control over the account used to book the ride.
The situation escalated dramatically when the driver reportedly swerved across lanes of traffic and onto the freeway shoulder, insisting that Sarabia and her children exit the vehicle in an unsafe location. In a particularly distressing moment, the driver allegedly struck Sarabia and one of her children as they attempted to escape the situation, leading to injuries. In a desperate act of self-defence, Sarabia resorted to using pepper spray against the driver, who then retaliated by throwing an unidentified liquid at her before fleeing the scene.
Following the incident, law enforcement created a report based on Sarabia’s account, which included allegations of assault, battery, false imprisonment, and negligence against both the driver and Uber. Sarabia’s claim suggests that these actions caused physical harm and emotional distress to her and her children.
In her lawsuit, Sarabia asserts that Uber displayed gross negligence by failing to implement appropriate safeguards that would prevent misuse of its platform. “Uber knew or should have known of the extreme risk created by its platform structure,” the complaint reads, pointing to concerns that drivers could potentially misuse ride status to endanger passengers.
