Halle Berry’s custody arrangement regarding her 13-year-old son, Maceo, will remain unchanged after a judge dismissed her ex-husband Olivier Martinez’s request for a domestic violence restraining order against her. The decision comes after a series of court hearings that took place over nearly two weeks, focusing on allegations of abuse made by Martinez.
According to sources, Martinez’s temporary restraining order—initially put in place following his claims against Berry—has now been lifted. The couple’s modified custody agreement, which limits Berry’s visitation hours with Maceo, is set to remain in effect until their next court appearance in November. Both parties are expected to reconvene to review their custody arrangement for their son.

Martinez had filed for sole custody of Maceo earlier this month, accusing Berry of physical abuse during an incident on September 26, along with alleged prior instances of abuse. In the immediate aftermath of these accusations, a judge issued a modification of the custody terms, allowing partial contact between Berry and Maceo to be upheld, but restricting her visitation to specific hours on Mondays, Tuesdays, Saturdays, and Sundays.
During the recent proceedings, Berry expressed her objection to Maceo testifying regarding the allegations, suggesting that Martinez was disregarding statements from other witnesses, including her 18-year-old daughter Nahla and her current partner, Van Hunt. This matter has added complexity to the custody hearings, as Martinez countered that Maceo wished to have his perspective on the matter heard in court.

Martinez described Maceo as wanting to share his account of the September incident and his custody preferences. In documents submitted to the court, he emphasised the importance of allowing their son to express himself, citing concerns that suppressing his voice might deter him from reporting any future issues.
Ultimately, the judge ruled that Maceo would be permitted to testify, although the scope of his testimony was restricted to the request for the restraining order rather than broader custody matters. Maceo had already provided evidence during a closed hearing earlier this month.
In the wake of these developments, Halle Berry has firmly denied the allegations of abuse. She asserts that she is actually a victim of domestic violence and has a history of supporting victims in similar circumstances. In a legal declaration during the proceedings, Berry stated categorically, “I have never physically, emotionally, or otherwise abused Maceo. I am a victim of domestic violence, and I help victims of domestic violence.”
Despite the severity of the allegations, Berry’s legal representative expressed satisfaction with the recent court ruling, which dismissed the restraining order. “We are extremely pleased that the Court has dissolved the TRO,” said Marina Beck, Berry’s attorney. “As we move forward, Halle is determined to continue to focus on the well-being and best interest of her family.”
In contrast, Martinez has maintained that his actions throughout this legal dispute are motivated solely by his desire to protect their child. He emphasised in a statement to the media that the health, welfare, and safety of their son is his utmost priority. “I hope that Halle takes responsibility for whatever happened that night and keeps our son’s welfare in mind,” he remarked.
The ongoing custody battle is unfolding against a backdrop of public interest, highlighting the complexities involved in high-profile separations and the impact of such legal disputes on children. As the date for their next court hearing approaches, both Berry and Martinez will continue to navigate this challenging chapter in their lives, with a shared focus on what is ultimately best for Maceo.
