A judge in New Mexico has issued a ruling in a case involving actor Timothy Busfield, allowing the dismissal of an indictment against him linked to charges of criminal sexual contact with a minor. The decision was revealed on Friday, October 16, by District Court Judge Joseph Montaño, who determined that the prosecutors had not conducted the grand jury proceedings in a fair and impartial manner.

The indictment originally included four counts of criminal sexual contact involving a minor under the age of 13. During the proceedings, the judge found that the prosecuting attorney had failed to adequately guide the grand jurors on the legalities of calling additional witnesses. This failure ultimately hindered the jurors from hearing essential testimony that could have influenced their decision-making.

Judge Montaño highlighted that the manner in which the grand jury proceedings were conducted breached established statutes meant to uphold the integrity of the grand jury system. He noted, “The prosecuting attorney failed to act in a fair and impartial manner,” which led to a situation that constrained the jurors’ ability to consider all relevant evidence. The judge emphasised the importance of allowing the grand jury to function in a way that honours the presumption of innocence and fairness in the justice system.

Despite the judge’s ruling in favour of Busfield, the dismissal does not preclude prosecutors from seeking to bring new charges against him. A spokesperson for the Bernalillo County District Attorney’s Office conveyed that they are currently reviewing the ruling to determine the next steps in response to the development.
Busfield had filed a motion to have the charges dismissed earlier in June, claiming that prosecutorial misconduct had tainted the grand jury process. His legal team argued that prosecutors had deviated from their duty to act neutrally and had misleadingly presented the legal standards for witness testimonies. They accused the prosecution of improperly cross-examining Busfield while ignoring evidence that could support his defence.
During a hearing held on September 25, testimony was provided by eight witnesses who were prepared to testify at the grand jury proceedings. The court found that jurors had explicitly expressed a desire to hear from additional witnesses on multiple occasions. However, they were misinformed regarding the necessity for a majority agreement to bring back witnesses, a requirement not supported by law.
The state, in contrast, claimed that Busfield’s defence team had failed to follow appropriate protocols for submitting evidence that could support their case.
The charges against the 69-year-old actor arose from allegations involving two minor boys, with the indictment being handed down in February. The incidents cited in the indictment allegedly occurred in October 2022 and September 2023. Busfield has consistently pleaded not guilty to all charges.
Following his indictment, Busfield’s civil attorney asserted concerns about the evidence presented by the state. He suggested that the case against Busfield was fundamentally flawed, raising doubts about its viability in a trial setting. He described the prosecution as motivated by factors beyond the facts of the case, emphasising the need for a thorough examination of the evidence in a court of law.
The case began after an arrest on January 13, leading to a series of events that has deeply affected Busfield’s personal and professional life. Following his release from custody, he was mandated to comply with specific conditions, including avoiding contact with the alleged victims.
Interestingly, Busfield’s wife, Melissa Gilbert, has publicly supported him throughout this challenging period. In an emotional interview, she shared insights into their relationship and the distressing impact of the legal issues on their family life. Gilbert reaffirmed her belief in Busfield’s innocence and the correctness of his narrative surrounding the allegations.
With the judge’s ruling now in place, it remains uncertain how this decision will impact the timeline of any future proceedings against Busfield. His next court dates and potential new developments in the case will likely continue to attract public interest.
This ruling serves as a significant moment in a legal battle that has been marred by disputes over procedures and the standards of justice, raising questions about the balance between prosecutorial power and the rights of the accused. If new charges are brought, it will be crucial for the legal system to ensure fairness and transparency throughout the process.
