A judge in Los Angeles County has granted a temporary restraining order against actress Halle Berry, following allegations made by her ex-husband, Olivier Martinez, regarding the treatment of their 12-year-old son, Maceo. The order, granted on October 1, 2023, restricts Berry’s visitation with their child but does not prevent her from contacting him entirely.

In his petition, Martinez claimed that Berry had been verbally abusive towards him and had physically abused their son. The court documents indicate that the judge issued a modified visitation schedule, allowing Berry to see Maceo on Mondays, Tuesdays, Saturdays, and Sundays from 10 a.m. to 8 p.m. However, the request to monitor Berry’s sobriety was denied due to a lack of sufficient information.
Berry’s attorney, Marina Beck, has strongly rejected Martinez’s claims, labelling the filing as “entirely meritless and deliberately misleading.” She expressed that while Berry is saddened by these allegations, she remains committed to prioritising Maceo’s wellbeing and fighting for his best interests.

Martinez’s accusations include a disturbing incident in which he asserts that Berry grabbed Maceo by the neck and began choking him while shouting, “Who is dominant now?! Who is dominant?” He also outlined a history of alleged abuse, including previous episodes of verbal and emotional mistreatment towards himself as well as their son.
According to Martinez’s lawyer, Patrick Baghdaserians, the primary motivation for the restraining order was to ensure the safety and welfare of Maceo. He noted that Martinez is a devoted father who has endeavoured to do his best within a challenging co-parenting dynamic. Baghdaserians emphasised the importance of Berry receiving the help necessary to improve her situation for the sake of their child.

This recent legal dispute has emerged nearly three years after Berry and Martinez finalised their divorce following an eight-year marriage fraught with difficulties. The divorce settlement included provisions for Martinez to receive monthly child support, calculated at £8,000 and an additional percentage of Berry’s income should it exceed £2 million.
The temporary restraining order will remain in effect until a court hearing scheduled for October 16, at which time there will be a further review of the allegations and a determination of whether the order will be made permanent.
