A Miami-based attorney has launched legal action against American Airlines, alleging negligence and defamation following an incident aboard a flight in which he claims a drunk seatmate assaulted him. David Cruz has filed a civil complaint in the U.S. District Court for Southern Florida, seeking damages exceeding $75,000 for what he describes as a troubling mid-air altercation that left him with physical and emotional injuries.

The incident reportedly occurred on September 30, 2025, as Cruz prepared to board flight 2290 from Miami International Airport to Los Angeles International Airport (LAX). Cruz, who was travelling under a non-revenue privilege due to his mother’s employment with the airline, claims he encountered significant trouble as soon as he settled into his seat.
According to the lawsuit, Cruz observed that a fellow passenger, who appeared to be visibly intoxicated, exhibited aggressive and belligerent behaviour. The flight attendants allegedly moved this passenger to seat 17A, placing him directly next to Cruz. The legal documents assert that the man struck Cruz multiple times in the arm and ribs, and even threw a bottle of wine at him, which soaked his belongings and clothing.
Cruz has expressed concern that crew members failed to intervene during the ordeal. He contended that when he sought assistance to manage the unruly passenger, his requests were ignored. In an effort to protect himself and document the behaviour of the seatmate, Cruz began recording audio and video during the flight.
Upon landing at LAX, Cruz claims to have faced hostility from a flight attendant who confronted him aggressively while attempting to explain the situation. He alleges that the staff member accused him of being intoxicated and dismissed his attempts to clarify the misunderstanding. Furthermore, Cruz asserts that he was informed that law enforcement had been contacted, a claim subsequently refuted by the same crew member when confronted with evidence on Cruz’s recording. Meanwhile, the passenger who allegedly assaulted him was allowed to leave the airport without facing any consequences.
Later that evening, Cruz sought medical attention at an emergency facility, where he was treated for bruises on his arm and ribs as a result of the altercation. Following this incident, Cruz claims that an internal review was conducted by American Airlines regarding the circumstances of the flight. In response to the alleged assault, Cruz’s mother filed a complaint with American Airlines’ Travel Allegations department, yet he claims that no representative reached out to discuss the incident, thereby exacerbating his distress. Cruz is self-representing in the lawsuit and has requested a jury trial.
The basis of Cruz’s legal claim includes five counts: negligence, negligent training and supervision, defamation per se, intentional infliction of emotional distress, and negligent infliction of emotional distress.
