A 46-year-old man has been arrested and is now in immigration custody following a tragic boat capsizing incident in New York Harbour. The crash, which occurred on August 8, resulted in the deaths of a young mother and her five-month-old baby. Manuel Ernesto Hernandez-Umana faces deportation and multiple criminal charges in connection with the disaster.

The U.S. Immigration and Customs Enforcement (ICE) apprehended Hernandez-Umana after a thorough investigation by the Coast Guard revealed that he was unlawfully residing in the United States. According to the Department of Homeland Security (DHS), Hernandez-Umana claimed to have illegally entered the country via Texas in 2007 and falsely represented himself as a U.S. citizen to a Customs and Border Protection officer.
During the ill-fated boat ride, Hernandez-Umana allegedly operated an overcrowded vessel carrying 14 people despite its maximum capacity being only ten. Tragically, following the capsizing, the bodies of the mother and her infant daughter were recovered by emergency responders and taken to a nearby Brooklyn hospital, where they were pronounced dead. The remaining eleven passengers, along with Hernandez-Umana, survived the incident.
In the wake of this harrowing event, the U.S. Attorney’s Office for the Southern District of New York announced that Hernandez-Umana had been charged with two counts of misconduct resulting in death and neglect of a ship officer. Federal prosecutors have stated that he was conducting unlicensed tours, lacking both a Merchant Mariner Credential and a valid Coast Guard Certificate of Inspection, which are required for commercial operations.
Additional allegations highlight that the infant was not equipped with a personal flotation device, and there were no suitable flotation devices for children on board. Such negligence added to concerns about passenger safety during the fateful trip.
Officials, including DHS Secretary Markwayne Mullin, have harshly condemned Hernandez-Umana’s actions. Mullin emphasised the recklessness of conducting unlicensed boat tours and stated that following the resolution of the criminal charges against him, the aim is to facilitate his removal from the United States.
Josh Packer, Assistant Director of the Coast Guard Investigative Service, stated that illegal boat charters endanger lives and termed the incident an “unthinkable tragedy.” He underscored the importance of adhering to safety regulations to prevent such unfortunate occurrences in the future.
The New York Police Department has also continued its investigation into the circumstances surrounding the capsizing, with Commissioner Jessica S. Tisch denouncing Hernandez-Umana’s disregard for safety protocols. She reaffirmed that piloting an over-capacity vessel without a proper licence demonstrated a blatant negligence toward the well-being of passengers.
