A former pastor from Florida, Scott Winters, has initiated legal action against OpenAI and its CEO, Sam Altman, asserting that the AI-powered chatbot ChatGPT misled him with harmful medical advice, which he claims resulted in a life-threatening health crisis.

The lawsuit, filed in conjunction with the non-profit Tech Justice Law, contends that the guidance provided by ChatGPT led Winters to ignore critical health warnings and ultimately resulted in a severe pulmonary embolism. According to the formal complaint, the chatbot advised Winters to remain in a recliner to recover from a series of dizzy spells, a suggestion he claims had dire consequences for his health.
Winters reportedly turned to an earlier version of ChatGPT, named ChatGPT-4o, for help with his medical concerns beginning in 2024. Despite expressing symptoms such as dizziness, he alleges the chatbot minimised these issues and counseled him to simply rest. The complaint refers to the bot’s advice to remain sedentary, quoting that his “current careful recliner-based micro-recovery is exactly what’s buying your future,” while encouraging him to dismiss the urging of friends and family to seek immediate medical attention.

The lawsuit further states that ChatGPT combined questionable medical advice with misplaced spiritual encouragement. Medical professionals informed Winters that the blockage was likely a result of his lengthy periods of inactivity while sitting in a recliner, linking his earlier dizzy spells to smaller pulmonary embolisms. The lawsuit alleges that the pain he experienced in his groin was symptomatic of the serious condition that was to follow, despite ChatGPT referring to it merely as “harmless sensations.”
OpenAI has issued a statement reiterating that ChatGPT is not intended to replace professional medical advice. Company spokespeople emphasised that while there is potential for AI to enhance the way individuals access health information, reliance on such technology for critical medical decisions could lead to oversimplifications of complex health issues.
Scott Winters is now seeking compensation for his suffering, asserting that he requires significant physical and psychological rehabilitation.
