A man from California is facing serious legal consequences following a tragic incident during a Fourth of July celebration in which an eight-year-old girl lost her life due to a fireworks explosion. Earl Decastro, aged 47, has been charged with involuntary manslaughter and a series of other offences that could result in a prison sentence of up to six years.

The charges against Decastro were formally announced by the Orange County District Attorney’s Office. They include one count of involuntary manslaughter, recklessly setting a fire that caused significant bodily injury, as well as illegal possession of over 100 pounds of dangerous fireworks. The case has garnered considerable attention given the young victim’s age and the details surrounding the incident.

The tragic events unfolded at Decastro’s home in Buena Park, California, where he hosted a Fourth of July party. According to reports, he had been setting off fireworks for nearly an hour before igniting a particularly dangerous “cake” firework that had been purchased for $400. This firework was made with “professional grade explosives” and was intended to serve as a grand finale for the event.
Witnesses claim that shortly after Decastro lit the firework, it malfunctioned, causing aerial mortar shells to shoot unpredictably into the driveway, where guests had gathered to enjoy the display. Among those watching was Jasmine Nguyen, who was seated near a table containing even more unspent fireworks. Tragically, as partygoers began to flee into the house for safety, the unspent fireworks exploded before Jasmine could escape.
First responders arrived swiftly at the scene but were unable to revive Jasmine, who was pronounced dead shortly after. The incident has shocked the community, particularly given the innocent nature of the holiday celebration.
Orange County District Attorney Todd Spitzer expressed outrage over the incident, stating that the use of illegal fireworks has severe consequences, particularly when it leads to the loss of life. “There is nothing accidental about buying and lighting illegal fireworks,” he remarked. “An eight-year-old little girl is dead, and the man who killed her is going to be held responsible. A few seconds of fun is not worth a lifetime of trauma and the loss of a beautiful little girl who never had the chance to grow up,” he added.
Decastro was initially arrested on the night of the incident but was later released on bail. Following the charges, he now awaits further legal proceedings, which could see him facing significant prison time if convicted.
In the wake of this devastating incident, a GoFundMe campaign has been established by Jasmine’s family to assist with memorial expenses. The campaign has reportedly raised over £66,000, highlighting the community’s support and sorrow following the tragedy. The outpouring of love for Jasmine has reached far beyond her immediate family, resonating with many who have been touched by this heartbreaking event.
As the legal process unfolds, both the local community and the family continue to grapple with the sudden loss of a young life. The incident serves as a sobering reminder of the dangers associated with the use of illegal fireworks and the potential for devastating outcomes in seemingly celebratory situations.
