Brian Nowicki, 49, has been charged with multiple offences linked to the fatal incident. Among these charges are operating a vehicle while intoxicated, which has drawn significant attention from local authorities. The Michigan State Police (MSP) stated that the collision occurred at approximately 11:11 PM when Nowicki allegedly attempted to overtake the van in which the teenagers were travelling. After coming from a casino, he swerved back into the original lane to avoid an oncoming vehicle, ultimately colliding with the van.
The van was forced into the eastbound lanes of the highway, where it was subsequently struck by two other cars. Witness accounts reveal that these vehicles were being driven by a husband and wife who were returning home from their own outings. Following the crash, a female driver from one of the latter vehicles sustained injuries and was taken to a nearby hospital for treatment.
The families of McFerrin and Pettengill expressed their devastation over the sudden loss. A GoFundMe page was established to assist with the couple’s funeral expenses and to support their infant son. In their heartfelt message, the family conveyed that words could hardly capture the pain of such a shocking loss. Nowicki made a court appearance on June 22, where he was ordered to be held on a bond of $2 million. The prosecution presented evidence of Nowicki’s troubling past, which includes a number of previous alcohol-related offences. Montcalm County Prosecuting Attorney Thomas Ginster recounted a history of violations, alleging that Nowicki had previously tested positive for alcohol while on probation. He characterised Nowicki as a clear danger to both himself and the public, which likely played a role in the substantial bond amount set by the judge.
