Josh McRoberts, a former NBA player known for his stints with the Indiana Pacers, Miami Heat, and Los Angeles Lakers, has filed a legal complaint alleging that his late grandmother was manipulated into relinquishing her family’s estate shortly before her passing. The complaint, submitted on June 1 in Boone County, Indiana, claims that Carolyn Pennington, who suffered from dementia, was unduly influenced by her neighbours, Jon and Sarah Sampson.

According to the documentation obtained by PEOPLE, McRoberts asserts that his grandmother was not in a sound state of mind when she signed over the deed to the 150-year-old property in Zionsville, Indiana. The estate was reportedly transferred for a mere $750,000, a sum significantly below its market value, despite McRoberts having previously invested $1 million in efforts to preserve it for the family.
The estate, which sits on seven acres of cherished land, has been held within the Pennington family for generations. The complaint states that Carolyn Pennington had always been devoted to protecting the property with the intention of keeping it within the family circle. Following financial difficulties, she had approached her grandson for assistance in paying off the mortgage and managing repairs, aiming to safeguard the home for future generations.

Allegations within the complaint suggest that the Sampsons, who had long pressured Carolyn to sell her home, succeeded in isolating her during a vulnerable period. In October 2025, her declining health prompted her move to an assisted living facility, where a formal assessment revealed she was suffering from dementia. During this time, she only had limited family interaction, primarily visits from her daughter, Jennifer McRoberts.
In a troubling turn of events, while Jennifer was away on holiday for five days in April 2026, the complaint alleges that Sarah Sampson removed Carolyn from the assisted living facility and confined her in a separate home owned by the Sampson family. During this isolation, Carolyn was reportedly deprived of contact with her family.
The record shows that shortly after this confinement, Carolyn experienced a decline in her health that necessitated a visit to the emergency room. It is alleged that Sara misrepresented the support Carolyn had from her family to medical personnel, creating an impression that she had no family to help her.
While in hospital care, Carolyn was reportedly presented with legal documents pertaining to the property transfer. The complaint states that the attorney, Michael L. Einterz, who allegedly represented her interests, acted in favour of the Sampsons, persuading Carolyn to sign over the property against her best interests. This transaction, according to the filing, occurred without any prior property appraisal.
Legal experts consulted by PEOPLE noted that the validity of the documents signed in hospital has been called into question owing to concerns over Carolyn’s mental capacity at the time of signing, as well as potential undue influence by the Sampsons and Einterz.
The complaint further asserts that the Sampsons intended to deprive Carolyn and her estate of the property’s value, seeking damages including attorney fees and associated costs. The Sampsons have publicly denied the allegations, asserting that they will provide a thorough response in due course.
This case highlights the complex legal and emotional issues surrounding elder abuse and estate disputes, particularly when mental health is compromised. The outcome may have significant implications not only for the McRoberts family but also for the broader discourse on protecting vulnerable individuals from exploitation. As the case develops in the courts, it will be closely scrutinised, particularly by those concerned with the rights and welfare of the elderly.
McRoberts, having dedicated substantial resources to the estate’s upkeep, now faces the challenge of navigating the legal system to secure what he believes is rightfully his family’s heritage. As this story unfolds, further responses from the Sampsons and associated parties are anticipated, underscoring the tensions inherent in family and community dynamics.
