During a hearing on 5 May, Horner, now 34, received his death sentence after jurors deliberated for approximately three hours. The courtroom was filled with tension as agonising details surrounding the case unfolded, culminating in a shocking confrontation between the prosecution and the defence over the nature of Horner’s actions.
In his closing arguments, Wise County District Attorney James Stainton described Horner as a “lethal predator,” arguing that his actions exemplify the very reason the death penalty persists in Texas. He emphasised that society must confront such evil, asserting, “We can never turn our back.” Stainton maintained that individuals like Horner should never be able to harm anyone again.

The defence team, however, presented a contrasting view. Defence attorney Susan Anderson expressed empathy for the jurors as they grappled with the gravity of the decision before them. “You hold a man’s life in your hands, and your decision will define who you are,” she admonished. Anderson urged that the jury consider a life sentence without the possibility of parole instead of capital punishment, appealing to their sense of mercy rather than vengeance.
Stainton swiftly countered this argument by pointing out the absence of any remorse shown by Horner. He highlighted the egregious nature of the crime, imploring jurors to avoid allowing Horner another opportunity to inflict harm. The prosecution’s stance was clear: Horner was a threat who warranted the most serious punishment available under the law.
The defence concluded its case on 4 May, after introducing a forensic psychologist who had diagnosed Horner with bipolar I disorder and indicated he met the criteria for autism. However, the prosecution responded unexpectedly with a witness whose testimony stated that Horner had allegedly abused him as a child, casting further doubt on Horner’s character.
The harrowing details of Athena’s abduction were presented in court, detailing how she was kidnapped while playing in her family’s driveway as Horner made a package delivery. The chilling audio and video evidence played for jurors revealed the tragic encounter. In one distressing moment caught on tape, Athena asks Horner if he is a kidnapper, to which he curtly replies that it does not matter where they are going. As events unfolded, his frustration grew, culminating in threats against her, showcasing a chilling pattern of manipulation and aggression.
As the situation escalated, jurors heard the sound of distress and desperation in Athena’s voice as she cried for her mother and resisted Horner’s commands. The evidence presented was described as both disturbing and heartbreaking, leading many jurors to tears. In one of the most gut-wrenching moments, after being ordered to undress, Athena’s voice echoed her innocence and fear, declaring, “No,” as she searched for her mother.
The medical investigation revealed the brutal nature of her death, attributing it to blunt force trauma, smothering, and strangulation. The horrors of her last moments under Horner’s control were starkly laid out in court. Days later, her body was discovered in the Trinity River, sparking a wave of mourning that swept through the community and beyond.
Horner’s fate now lies with the judicial system as he confirmed his intention to appeal the death sentence. The case serves as a harrowing reminder of the potential dangers lurking in everyday situations and the impact of violent crimes on communities. As the trial draws to a close, those affected remember Athena as a vibrant young girl whose life was tragically cut short, leaving an indelible mark on the lives of her family and friends.
