Mom Who Left Son in Hot Car While Getting Lip Filler Sentenced to 15 Years for His Death. The Boy’s Father Says It’s Not Enough

A young mother, Maya Hernandez, has been sentenced to 15 years in prison following the tragic death of her one-year-old son, Amillio Gutierrez. This sentence was delivered in a California court after Hernandez pleaded no contest to involuntary manslaughter, which allowed her to avoid a first-degree murder charge.

The distressing incident occurred on June 29, 2025, when Hernandez, 20, left her two sons unattended in her vehicle for approximately two hours. She had gone to a medical spa in Bakersfield for lip filler injections and left her one-year-old and two-year-old strapped into their car seats, as reported by local media outlets.

During the time the children were alone in the car, which had an exterior temperature of around 100 degrees, Amillio was discovered unresponsive upon Hernandez’s return. According to reports, his body temperature had soared to a dangerous 107 degrees. In contrast, his two-year-old sibling, who survived the incident, had a body temperature of 99 degrees.

Documents from the court indicated that the treatment Hernandez underwent lasted merely 15 to 20 minutes, yet the children were left in the vehicle for almost two hours. Although the air conditioning in the 2022 Toyota Corolla was initially set to a cool 60 degrees, the car had an automatic shut-off feature that disabled the engine after one hour. As a result, her sons were left in the sweltering heat for at least an hour without any cooling relief.

Amillio’s father, Rosendo Gutierrez, learned of his son’s death while serving time in jail for unrelated charges. He expressed his feelings of profound loss and disappointment when addressing the court’s decision. “I think I let them down because I wasn’t there to save them,” Rosendo said. He added that he felt the 15-year sentence was far too lenient, especially given the circumstances. “This should have never happened… it just kills me,” he lamented.

At the sentencing hearing, Amillio’s grandmother, Katie Martinez, shared her devastation over the loss of her grandson. “Fifteen years doesn’t seem like enough,” she stated emotionally, highlighting the impact of the tragedy on the family and lamenting the lifetime of milestones they will miss. “We will have a lifetime without Amillio. We’ll never attend graduation, birthday parties or even have him sitting at the kitchen table watching him eat a simple meal.”

Judge Charles Brehmer acknowledged that Hernandez had already served over 280 days in custody during the various stages of her case. He presided over the hearing on March 5 and reflected on the complex emotions surrounding such a heartbreaking matter.
