A Kentucky couple, Shawn Durbin, 39, and Nancy Ann Durbin, 36, are facing murder charges in connection with the tragic death of 62-year-old Bobby Pennington. The charges stem from an incident where the couple allegedly threw Pennington off a second-story balcony, leading to his untimely demise.
Initially, the couple was arrested on first-degree assault charges, but these were later upgraded to murder following Pennington’s passing due to the injuries sustained from the fall. The disturbing incident unfolded at an apartment complex on East Memorial Drive in Elizabethtown on November 13. Officers were alerted to the situation after receiving a report of an adult male in cardiac arrest, but the situation quickly escalated when it was revealed that Pennington had been thrown off the balcony.

Responding to the distressing scene, Elizabethtown Police Public Information Officer Chris Denham informed PEOPLE, “While our officers were responding, they were updated that the individual in question had been thrown from a second-story balcony.” Pennington was rushed to Baptist Health and later transferred to a university hospital, where he tragically passed away on November 17.
The tragic turn of events has shocked the residents of the apartment complex, where Pennington and the accused couple resided. Denham noted that a prior dispute occurred before the fatal act took place, but it remains unclear what led to such a violent and deadly altercation. Describing the incident as “despicable,” Denham expressed bewilderment over the motive behind the heinous crime, stating, “There was no indication that Mr. Pennington had caused these two any problems.”
According to details from Nancy Durbin’s police citation, a witness observed the couple physically dragging Pennington from in front of an apartment belonging to the Durbins, before callously throwing him over the second-story balcony handrail. The fall, measuring approximately 11 feet and 6 inches, resulted in Pennington landing on a concrete pad with fatal consequences.
In addition to the murder charge, Shawn Durbin is also facing two counts of third-degree assault and one count of resisting arrest for his aggressive behaviour towards law enforcement. Reports indicate that he attempted to kick out a patrol car window, spat on a police officer, and engaged in physical altercations with officers.
A grand jury indicted the Durbins on November 20, and both individuals are set to be arraigned on December 9. Presently, they are being held at the Hardin County Detention Center as they await further legal proceedings in this harrowing case.
The tragic death of Bobby Pennington serves as a stark reminder of the devastating consequences of violence and aggression. The community mourns the loss of a life, while authorities work diligently to seek justice for the victim and ensure accountability for those responsible. Such senseless acts of violence highlight the importance of resolving conflicts through peaceful means and promoting a culture of respect and understanding in our society.
