The US Department of Justice is currently investigating United Parks & Resorts Inc., the parent company of SeaWorld, for alleged civil rights violations. This investigation stems from complaints filed against the company after it banned rollator walkers with seats from three of its Florida amusement parks: SeaWorld Orlando, Busch Gardens Tampa Bay, and Aquatica Orlando.

The Justice Department’s investigation is focused on determining whether United Parks & Resorts Inc. violated the Americans with Disabilities Act (ADA) by discriminating against guests with disabilities. This investigation was prompted by public complaints following a sudden policy change by the company, where they quietly banned rollator and wheeled walkers with seats in early November.
According to reports, the company updated its accessibility statements on the parks’ websites to reflect the ban on rollator walkers with seats. The updated policy now permits rollator and wheeled walkers without seats, as well as other mobility options such as wheelchairs and Electric Convenience Vehicles (ECVs) for guests.

The Justice Department’s letter opening the investigation highlighted concerns that suggesting guests with disabilities rent alternative mobility devices could also potentially be a violation of the ADA. Many individuals, including Nancy Schwartz, a SeaWorld Orlando regular, expressed disappointment over the sudden policy change, stating that it limits their mobility and access to the parks.
In response to the investigation, U.S. attorney Gregory W. Kehoe for the Middle District of Florida emphasised the importance of equal access to public accommodations for individuals with disabilities. The department encourages individuals who believe they have faced discrimination from the company to file a complaint with the Civil Rights Division online.
United Parks & Resorts Inc. has yet to respond to requests for comment on the investigation. The outcome of this investigation could have significant implications for how amusement parks and other public facilities accommodate guests with disabilities, highlighting the importance of upholding civil rights and accessibility for all individuals.

This investigation serves as a reminder of the ongoing efforts to ensure equal access and treatment for individuals with disabilities in public spaces. It underscores the importance of businesses and organisations adhering to ADA guidelines to promote inclusivity and accessibility for all individuals, regardless of their physical abilities. Stay tuned for updates as this investigation unfolds and potential implications for the wider theme park industry.
