Australian singer Sia’s estranged husband, Dan Bernad, has recently been denied sole custody of their 19-month-old son, Somersault, following his filing of an emergency order seeking custody. Court documents obtained by PEOPLE reveal that a judge ruled in favour of maintaining the existing custody arrangement, giving Sia primary custody of their son and allowing for limited and monitored visitation for Bernad.
The judge’s decision was based on the lack of evidence presented by Bernad to support his claim for emergency custody. The court highlighted that the information provided in Bernad’s filing had already been known since their hearing in August 2025. Therefore, the previous legal and interim custody agreement from August 1, 2025, will remain in place, with Sia retaining primary custody.

In response to Bernad’s claims that Sia is unfit and unreliable as a parent due to alleged substance abuse issues, court documents revealed that Sia has been sober for over six months and is actively engaged in a recovery program that includes regular testing and support. The singer cited Bernad’s lifestyle choices, including nightlife and recreational drug use, as incompatible with creating a healthy environment for their child.

Furthermore, Sia disputed Bernad’s assertion that she had not taken a primary caregiving role, stating that their son had always been under her primary care and custody. She also raised concerns about Bernad’s financial motives, claiming that his requests for additional custodial time were motivated by financial gain rather than a genuine desire to foster a meaningful relationship with their son.
In addition to seeking sole custody, Bernad had requested Sia to undergo regular drug testing, participate in co-parenting classes, and adhere to monitored visitation terms. He also asked for a substantial amount of $77,245 per month in child support, highlighting his current unemployment status and lack of income.
Sia, who adopted two 18-year-old boys in 2019, expressed her belief that Bernad’s financial demands were unjustified, noting that she had already paid him $300,000 since their separation in March. The singer maintained that her focus remains on providing a safe and stable environment for her children, countering Bernad’s allegations with evidence of her commitment to her son’s well-being.
The legal battle between Sia and Bernad continues to unfold, with each party presenting their perspectives on the custody and financial support arrangements for their son. As the situation evolves, it remains to be seen how the former couple will navigate their co-parenting responsibilities and reach a resolution that prioritises the best interests of their child.
In conclusion, the intricacies of high-profile custody disputes shed light on the complexities of navigating family dynamics post-separation. The case of Sia and Dan Bernad serves as a reminder of the challenges faced by parents in ensuring the welfare of their children amidst personal differences and legal proceedings.
