Harvey Weinstein’s Sentencing for Sex Crime Delayed in New York Court
Harvey Weinstein, the disgraced film producer, had his sentencing postponed to the end of September by a judge in New York. The delay comes after Weinstein was found guilty of a criminal sex act during his retrial on criminal charges. Weinstein, 73, had arrived in court on Wednesday, Aug. 13, expecting to be sentenced for his crimes but instead, the judge scheduled a pre-sentencing hearing.
During the hearing, Weinstein was presented with an offer to plea on a rape charge, which had resulted in a mistrial in his recent trial. By entering a plea and waiving his right to appeal, Weinstein could avoid standing trial for a third time on that specific charge. Prosecutors expressed readiness to proceed with the trial in January if necessary. The judge stated that if a trial were to occur, it should take place within the year, and a date would be set at the September hearing if required.
After a seven-week trial that commenced in April, Weinstein was found guilty by jurors of a criminal sexual act against Miriam “Mimi” Haley, a former production assistant, but acquitted of a similar charge involving model Kaja Sokola. The mistrial was declared on a rape count involving actress Jessica Mann, who accused Weinstein of raping her in 2013.
Weinstein had previously been convicted of criminal sex act and rape in a 2020 trial and given a 23-year prison sentence, which was later overturned in 2024. The decision to overturn the verdict led to his second trial, which took place less than a year later. Despite avoiding serving his sentence in New York, Weinstein was transferred to California to serve a 16-year prison term following a separate 2022 trial.
Facing multiple health issues including heart problems, cancer, and diabetes, Weinstein remains in custody in a facility in Rikers, reserved for individuals requiring constant medical care. He appeared in court in a wheelchair on Wednesday. Weinstein’s representative, Juda Englemeyer, highlighted the toll the legal proceedings have taken on his health and called for an end to the ongoing public scrutiny.
The allegations against Weinstein led to his expulsion from Hollywood and the Academy of Motion Pictures Arts and Sciences, making him one of only two Oscar winners to be expelled. Over 100 women, including high-profile figures like Gwyneth Paltrow and Angelina Jolie, accused him of sexual misconduct or assault.
