The President of El Salvador, Nayib Bukele, has stated that he lacks the authority to return a Maryland father who was mistakenly deported to a prison in El Salvador. Kilmar Abrego Garcia, a legal resident of Maryland, was sent to the Terrorism Confinement Center in El Salvador on March 15 due to an administrative error by the Trump administration. Despite being a lawful resident with no criminal record, Bukele has referred to him as a “terrorist” and refused to release him.

During a recent meeting in the Oval Office between the leaders of the US and El Salvador, Bukele adamantly stated that he would not facilitate Abrego Garcia’s return to the United States. He dismissed the suggestion of releasing him into the custody of El Salvador, citing concerns about allowing criminals back into the country. This refusal comes despite calls for Abrego Garcia’s repatriation following the erroneous deportation.
The situation involving Abrego Garcia has been complicated by conflicting claims from US officials. Secretary of State Marco Rubio erroneously stated that Abrego Garcia was illegally in the United States, justifying his deportation. However, Abrego Garcia had legal protected status in the US due to concerns of gang-related persecution in his home country of El Salvador.
The Oval Office meeting took place following a Supreme Court ruling that instructed the Trump administration to facilitate Abrego Garcia’s return and correct the mistake. Despite this legal directive, both the Trump administration and Salvadoran officials have pushed back on taking responsibility for the situation. US Attorney General Pam Bondi emphasised that the decision to repatriate Abrego Garcia lies with the Salvadoran president.
The refusal to return Abrego Garcia has sparked outrage and concern among advocates for immigrant rights and due process. The case highlights the complexities and challenges faced by individuals caught up in immigration-related issues, particularly when errors or misunderstandings lead to severe consequences such as wrongful deportation.
As the legal and diplomatic wrangling continues, Kilmar Abrego Garcia remains in the custody of El Salvador, far from his family and support network in the US. The case serves as a poignant reminder of the human cost of bureaucratic errors and the importance of upholding the rights and dignity of individuals, regardless of their immigration status.
The international attention drawn to Abrego Garcia’s case underscores the broader issues surrounding immigration policies and the need for greater accountability and compassion in addressing the complexities of migration. Advocates and supporters continue to press for his safe return and call for a more humane and just approach to immigration enforcement.
