New York City’s Brad Lander Reflects on ICE Arrest as Immigrant Advocates Question Detention Practices

New York City Comptroller and mayoral candidate Brad Lander recently made headlines after revealing his experience of being arrested by Immigration and Customs Enforcement (ICE) while accompanying an asylum seeker. Lander, known for his advocacy for immigrant rights, used this platform to shed light on what he believes are the harsh realities faced by immigrants on a daily basis.
In a candid interview with PEOPLE, Lander expressed his concerns about the treatment of immigrants in ICE custody, stating that they often face far worse circumstances than his own arrest. Having escorted several individuals to and from immigration court through the non-profit organization Immigrant Arc, Lander highlighted the lack of basic rights extended to non-citizens during ICE encounters.
One issue Lander pointed out was the absence of Miranda rights, immediate access to translators, and the lack of communication with families during arrests. The complex legal system surrounding deportation proceedings does not mandate the reading of Miranda rights to non-citizens, leaving many individuals in the dark about their situation.
According to Lander, immigrants detained by ICE in New York are typically brought to facilities like 26 Federal Plaza in Manhattan, where overcrowding and inadequate living conditions have raised concerns. Despite efforts by members of Congress to gain access to these facilities, transparency regarding the treatment of detained individuals remains limited.
In a letter addressed to the U.S. Department of Homeland Security and ICE, concerns were raised about the living conditions at 26 Federal Plaza. Deputy director Bill Joyce acknowledged the lack of beds and medical services at the facility, stating that detainees were forced to sleep on the floor or benches.
Lander’s arrest, captured in a viral video, showcased the reality faced by many immigrants in similar situations. He emphasised that individuals like the asylum seeker he was assisting, named Edgardo, are the ones truly experiencing a violation of their rights. Lander urged for more advocacy and support for vulnerable immigrant populations who often lack legal representation and resources.
As a candidate in the mayoral race, Lander highlighted the importance of standing up for all New Yorkers, including immigrants who contribute significantly to the city’s cultural fabric. He stressed the need for greater awareness and action to address the systemic challenges faced by immigrant communities, calling for a more compassionate and just approach to immigration policies.
