Blake Lively has made a recent legal move to withdraw two claims against Justin Baldoni, the director and costar of “It Ends with Us,” relating to emotional distress. However, despite dropping these specific claims, Lively still has the opportunity to present evidence of emotional damages through other claims, excluding medical records, as ruled by a judge. The actress requested to dismiss claims of intentional infliction of emotional distress and negligent infliction of emotional distress on June 2. This decision followed a letter from Kevin Fritz, a lawyer for Baldoni, addressed to Judge Lewis J. Liman, requesting access to Lively’s medical and mental health care providers’ information for therapy notes and relevant medical details. Instead of complying with this request, Lively chose to withdraw the emotional distress claims without prejudice.
Judge Liman clarified on June 11 that if the claims were not dismissed, Lively would be precluded from offering any evidence of emotional distress. However, the court did not bar Lively from presenting evidence of other forms of emotional distress apart from those specifically withdrawn.
