A Texas woman is pursuing legal action against the popular fast-casual restaurant chain, Torchy’s Tacos, after allegedly discovering a cow’s tooth in her meal. Nohemi Castillo claims that during a takeaway order from a Torchy’s location in Austin on June 9, she almost swallowed the tooth while eating a beef cheek taco, known as the “Democrat” taco.

In her lawsuit, Castillo asserts that she was subjected to negligence, deceptive practices, and violations of food safety regulations. Seeking damages of up to $250,000, her complaint highlights a troubling encounter that left her feeling “grossed out and sickened.” Following the incident, Castillo sought medical attention and was prescribed medication due to her discomfort.
According to court documents, Castillo immediately informed the restaurant’s manager about her discovery. However, she alleges that it remains unclear what action, if any, he took in response to her complaint. The lawsuit claims that the presence of the tooth indicates that the food served was inadequately prepared, inspected, or delivered.

Castillo’s allegations extend beyond individuals to include the parent company of Torchy’s, Success Foods Management Group, LLC. She contends that the establishment engaged in practices that were unconscionable and misleading. Furthermore, she cites violations of the Texas Uniform Commercial Code and the Food Safety Modernization Act (FSMA), which stipulates that food facilities must evaluate potential hazards and implement preventive measures.

Steven Vasquez, Castillo’s attorney, expressed the profound impact of the incident on his client. He noted that she was in a state of shock upon discovering the tooth, describing it as a “large” object that was completely unexpected in her meal.
In response to the lawsuit, Torchy’s Tacos issued a statement on October 15, confirming that the item identified by Castillo was indeed a cow’s tooth. The company takes all food safety concerns seriously and prides itself on sourcing the highest quality ingredients. According to their statement, the barbacoa used in the “Democrat” tacos is sourced from natural beef cheek supplied by a designated supplier.
The statement further elaborated that while this type of occurrence is rare, it can happen during the meat processing phase. Torchy’s assures its customers that they are actively working with their supplier to implement measures aimed at preventing future incidents of this nature.
The situation has raised questions about food safety standards in the fast-casual dining sector and the precautions necessary to ensure that customers can enjoy their meals free from unexpected hazards. Castillo’s case highlights the potential consequences for businesses if they fail to adhere to strict food safety regulations.
As the lawsuit unfolds, it may serve as a cautionary tale for food providers regarding the importance of rigorous quality control practices. With increasing public scrutiny over food safety, establishments like Torchy’s Tacos will need to reinforce their commitment to maintaining high standards in food preparation and service.
For now, Castillo’s claims stand as a stark reminder of the importance of diligence in the preparation and inspection of food products, emphasising the responsibility that restaurants carry to provide safe dining experiences to their customers. As the case progresses, the wider community watches closely, eager to see how it might influence restaurant practices and consumer confidence in the food industry.
