A 28-year-old man from Pennsylvania has been found guilty of raping a 17-year-old girl who was unable to consent due to intoxication. The incident occurred in July 2024 on an island in the Susquehanna River, as reported by the Lancaster County District Attorney’s Office.

Witnesses testified that the victim had been socialising with friends along the riverbank when Salvador Villa-Del Toro approached on a jet ski. He offered the girl a ride, and she accepted, unaware of what was to come. Following the jet ski trip, the girl returned to her friends in a severely impaired state, approximating barely able to stand or walk.

Her friends immediately recognised that something was amiss. Concerned for her safety and suspecting she may have been drugged, they contacted local authorities, leading to the arrival of police at the scene. However, law enforcement officials were unable to converse with the teenager due to her condition. She was subsequently transported to a nearby hospital, where medical professionals collected a vaginal swab for examination.

The DNA results from the swab identified Villa-Del Toro as the perpetrator. Initially, Villa-Del Toro denied any sexual involvement with the victim. Nevertheless, he later confessed to having sexual relations with her after dropping her off near a swimming area but insisted that the encounter was consensual. Prosecutors argued that he was fully aware of her intoxicated state at the time.
A trial commenced, presenting evidence over five days. On September 24, 2024, a jury returned a verdict of guilty on multiple counts, including one charge of rape of an unconscious victim and various counts of indecent assault, aggravated assault, and unlawful contact with a minor, among others. The jury deliberated for about an hour before confirming their verdicts.
Judge Todd Brown, who oversaw the trial, is expected to determine Villa-Del Toro’s sentencing at a future date. The verdict has drawn significant attention to issues surrounding consent and the responsibilities of individuals in situations involving intoxicated minors.
This case underscores the critical importance of awareness regarding the serious implications of alcohol consumption and consent. Authorities continue to advocate for education surrounding these topics to prevent future incidents.
