Ofelia Garcia Ortega, 36, the girl’s mother, has recently been arrested for multiple offences related to the welfare of her daughter. The teenager, known only as Jane Doe, became the centre of an investigation when her premature infant, referred to by authorities as “Baby Angelita”, was found deceased on the side of a road in August. The circumstances surrounding the child’s death have prompted significant legal scrutiny and intervention from local and federal authorities.


Authorities allege that Ortega’s actions have severely endangered her daughter. Prosecutors assert that Ortega used forged documents to allow her 13-year-old daughter to work in agricultural fields—an act that constitutes a serious violation of child protection laws. Furthermore, the mother is accused of permitting Jane Doe to operate a vehicle without a driving licence and allowing her to remain absent from school for an extended period.
Garcia Ortega was taken into custody on 6 October and faces several charges, including two felony counts of possessing a forged identification card, a misdemeanor for endangering a child, and another for contributing to the delinquency of a minor. Following her arrest, a court approved an increase in her bail to £150,000.
This arrest marks Garcia Ortega’s second encounter with the law concerning her daughter’s wellbeing. She had previously been arrested in late August for child endangerment but was released on bail. It remains unclear if she still faces that charge.
Further complicating this tragic story is the role of the girl’s father, Sergio Galvez Perez, who allegedly fathered the infant. He is wanted on several charges related to sexual assault, including incest and lewd acts with a minor, all linked to the alleged abuse of Jane Doe. As of early October, Perez was apprehended in Mexico as part of a coordinated rescue operation that also located Jane Doe. Law enforcement officials reportedly discovered narcotics in his possession at the time of his arrest, and authorities believe he concealed the girl from law enforcement to evade capture.
Currently, the 14-year-old is receiving care from local authorities in Mexico, while discussions are ongoing regarding her legal situation. Initially, she was sought under an arrest warrant related to a murder charge, but the Monterey County District Attorney’s Office later clarified that no decision on formal charges against her had been made, highlighting the complexity of her position as both a potential victim and a suspect.
A spokesperson for the District Attorney’s Office emphasised that the 14-year-old is a victim of her father’s alleged abuse, stating, “No child should ever have to endure such horrific circumstances.” The focus now remains on both supporting the girl and pursuing justice regarding the charges faced by her parents.
