Starbucks has been ordered to pay $50 million to a man who suffered severe burns in a drive-thru incident in California. The incident occurred when a scalding drink spilled into the man’s lap, resulting in life-changing injuries. The lawsuit, which was brought by delivery driver Michael Garcia, ended with a Los Angeles County jury awarding him the substantial sum on March 14.

The delivery driver, Garcia, had visited a Starbucks location in Los Angeles on February 8, 2020, to pick up three Venti-sized “medicine ball” drinks. Tragically, a barista at the drive-thru had negligently placed one of the drinks in the to-go carrier with an unsecured lid. Surveillance footage of the incident captured the moment the lid popped off, causing the scalding contents to spill into Garcia’s lap within seconds. The resulting third-degree burns left Garcia permanently disfigured, with injuries to his genitals that required skin grafts.
According to Nick Rowley, Garcia’s attorney and Trial Lawyers for Justice co-founder, the injuries sustained by the delivery driver have profoundly impacted his life, turning once pleasurable experiences into moments of pain. The jury, after just 40 minutes of deliberation, sided with Garcia and Rowley, holding Starbucks accountable for the incident and ordering the chain to pay $50 million in damages.

Starbucks, in response to the verdict, expressed sympathy for Garcia but announced plans to appeal the decision. The coffee chain maintains that they were not at fault for the incident and considers the damages awarded to be excessive. Despite an initial settlement offer of $3 million, which Garcia accepted under certain conditions, Starbucks ultimately declined to settle the case before trial, leading to the courtroom battle.
Rowley stressed the significant impact of the verdict on Garcia’s life, stating that while the monetary compensation cannot reverse the permanent harm suffered, it represents a crucial step in holding Starbucks accountable for their failure to ensure customer safety. The legal proceedings have shed light on the importance of adhering to safety standards, especially when handling hot beverages in commercial establishments.
The case serves as a reminder of the potential consequences of negligence in food service environments and the responsibility that businesses bear in ensuring the safety of their customers. The verdict highlights the need for ongoing vigilance and adherence to best practices to prevent similar incidents from occurring in the future.
As the legal battle continues and Starbucks prepares to appeal the decision, the case underscores the importance of accountability and upholding safety standards in all aspects of consumer interactions. The $50 million verdict sends a clear message about the repercussions of failing to meet these standards and the need for businesses to prioritize customer well-being above all else.
