Blake Lively is seeking to recover over £8 million in legal fees and costs following the dismissal of a defamation lawsuit brought against her by actor Justin Baldoni. The request, which amounts to £8,035,040.88, has been lodged with a federal court, prompting further legal proceedings concerning the sums claimed.

This legal quest arises from a ruling made by Judge Lewis J. Liman, who found that Lively was entitled to pursue an award under California Civil Code Section 47.1. This statute is designed to protect individuals from retaliatory defamation lawsuits, particularly after they report incidents of sexual harassment or discrimination. The judge’s ruling established Lively as a prevailing defendant in this case, allowing her to seek reimbursement for legal expenses associated with the allegations made by Baldoni.

In her detailed filing, Lively’s legal team outlined their fee structure, specifying that £7,495,526.87 is attributed to attorneys’ fees, while an additional £539,514.01 covers litigation costs accrued during her successful defence against Baldoni’s claims. The lawyers explained that the complexity of the case, combined with its high profile, necessitated extensive legal work. They pointed out that costs significantly escalated due to the considerable media attention it garnered, which resulted in thousands of articles about the dispute.

The actions that led to this legal battle were linked to the production and marketing of the film “It Ends With Us,” which featured both Lively and Baldoni. Before a trial could begin, both parties reached a settlement in May, resolving broader litigation issues. However, Lively’s pursuit of attorney fees and costs remained outstanding, thus necessitating Judge Liman’s intervention to make a final determination.
As part of the proceedings, the judge has set a deadline for Baldoni and his production company, Wayfarer Studios, to respond to Lively’s fee request. They have until July 13 to contest the amount claimed. The court’s decision will determine whether Lively will receive the complete sum she is requesting or if it will be amended or denied entirely.
Baldoni’s representatives have not yet provided an official statement regarding the fee request. However, previous comments from his legal team indicate a more cautious approach. Attorney Bryan Freedman has downplayed the extent of Lively’s victory, noting that while the court allowed for limited attorney fees, it denied her requests for punitive and treble damages. Freedman emphasised that Lively’s legal journey was limited in scope and did not yield the broader success she may have hoped for.
In a statement following Judge Liman’s ruling, Lively’s attorneys expressed their satisfaction, describing it as a “total vindication” for their client. They underscored that Lively’s legal actions were legitimate, representing a response to allegations of retaliation linked to her initial reports of harassment. The granting of attorney fees was seen as a reinforcement of her position as a victim of retaliatory actions.
The courtroom drama illustrates the intricacies of defamation law and the protective measures built into the California legal system for victims of wrongdoing. It also highlights the often significant financial burdens associated with legal defence even when a party prevails in court.
As this case progresses, all eyes will remain on both Lively and Baldoni, particularly as they prepare for the proceedings set to unfold in July. The outcome may not only impact the individuals involved but further clarify the judicial interpretations of defamation laws as they relate to acts of retaliation in the entertainment industry.
