A man is pursuing legal action against Virgin Atlantic, alleging that he sustained severe burns after a hot cup of coffee spilled on him during a flight from Las Vegas to London. Nick Gibbs claims that the incident left him with noticeable scars and enduring physical and emotional distress, which he described as “excruciating pain.”

Speaking on the morning television programme Good Morning Britain, Gibbs recounted the events of the January 2025 flight. According to him, the flight attendant served him a cup of coffee without a lid, placing it on a tray already cluttered with his in-flight meal. Within moments, he said, the precariously balanced cup tipped over, pouring the scalding liquid directly onto his lap.

“The coffee just poured onto my lap, just fell off the tray,” Gibbs explained, noting that the tray was slanted, contributing to the unfortunate situation. He described the coffee as “boiling, boiling,” which soaked through his track pants and caused immediate, intense pain. Due to the position of the tray, Gibbs found it difficult to escape from his seat in a timely manner.

When Gibbs sought medical assistance, he claimed that the flight attendants provided him with two bottles of water in an attempt to alleviate the burns. However, he found this solution to be ineffective. “It was unbearable to try and pour them on the burned area,” he said. Gibbs mentioned that he was told a doctor would be waiting for him upon landing, but he alleged that no medical professional was present when the aircraft arrived at its destination.
Beyond the physical injuries, Gibbs highlighted the mental impact of the incident. He expressed that it severely affected his confidence, particularly in his relationship with his partner. “Looking at myself, I didn’t feel comfortable,” he articulated, further stating that the emotional toll delayed their plans to conceive. “It was tough,” he added, underscoring the broader implications of the incident on his life.
In response to Gibbs’ claims, a spokesperson for Virgin Atlantic extended an apology for his experience, acknowledging the distress it caused. The airline stated, “At Virgin Atlantic, the safety and wellbeing of our customers and our people is always our top priority.” They defended their practices by explaining that their cabin crew are extensively trained to serve beverages safely, with hot drinks prepared below boiling temperature and filled to a safe level in specialised cups designed to minimise spills.
Gibbs has decided not only to pursue legal recourse but also to advocate for changes in airline beverage service protocols. He argued that hot drinks should be served at a more moderate temperature, especially in crowded settings such as aircraft. “Serving boiling hot water on a tray that’s overcrowded, anyway, with no lid on it, is not how it should be happening,” he insisted, calling for widespread awareness regarding the severity of potential safety issues associated with hot liquids on planes.
As the case unfolds, Gibbs hopes to shine a light on the risks that passengers face when hot beverages are served in unsafe conditions, aiming to initiate a conversation on improving safety standards for airline passengers. The pursuit of this legal action serves as a reminder that lapses in protocol in confined spaces can lead to serious consequences, potentially affecting the lives of unsuspecting travellers.
