During court proceedings in Los Angeles, Cher’s attorney, Justin Gold, provided insights into Cher’s emotional state and her commitment to assisting her son. Gold described Cher, 79, as deeply affected by the situation, stating that she is striving to support her son as he navigates his challenges. “She’s doing all she can to help him,” Gold said. “She worries that he is gravely disabled due to his mental health and addiction issues.”
Despite her fervent desire to secure a measure of control over Allman’s affairs, the judge expressed that there was not enough immediate urgency to warrant the conservatorship at this time. However, the ruling was made “without prejudice,” meaning that Cher retains the option to file her petition again in the future.
Elijah appeared via video link from the psychiatric hospital in New Hampshire, where he is currently detained, facing several criminal charges stemming from two separate incidents. The court learned that Cher expressed concerns regarding her son’s financial management, claiming he has been misusing funds received from the trust of his late father, Gregg Allman. Cher’s lawyer specified that her son has been reportedly spending money on substance abuse and extravagant hotel accommodations.
Gold highlighted that although the upcoming distribution of funds from the trust was scheduled for 1 May, the judge doubted that Elijah would be able to access this money while he continues to receive treatment. He explained that the need for a conservatorship goes beyond just financial distribution, underscoring that Elijah is also burdened with significant debts, including tax issues that have been unattended for the past two years along with accumulating spousal support obligations.
Cher, who had previously sought conservatorship in 2023, had withdrawn her application nine months later after coming to a private agreement with Elijah. Now, however, she feels that more decisive action is necessary given the severity of her son’s situation. Gold suggested that while Elijah is in New Hampshire focusing on recovery, it is an opportune moment for addressing his financial troubles to help set him on a better path for the future.
The court heard that Elijah’s recent legal challenges began earlier this year when he was arrested in February in Concord, New Hampshire, for allegedly causing a disturbance at a prestigious preparatory school. He was subsequently charged with multiple offences, including simple assault and criminal trespassing. In March, he faced additional charges after being arrested for a break-in at a residential property in Windham.
With his next court appearance scheduled for 16 June, Elijah’s future remains uncertain as he contends with these serious allegations alongside his personal struggles.
