**Brother Sentenced for Homicide in Heartbreaking Case of Abuse and Neglect**

Tyler Peterson, aged 23, received a prison sentence in a Utah courtroom this past week after admitting guilt to charges stemming from the tragic death of his 12-year-old brother, Gavin Peterson. Gavin Peterson tragically passed away on 9 July 2024, and an autopsy revealed that the child’s body had suffered from extreme malnutrition, leading to the complete shutdown of his internal organs. This grim finding was outlined in a probable cause affidavit linked to Tyler’s charges of child abuse homicide, aggravated child abuse, and obstruction of justice.

The circumstances surrounding Gavin’s death were harrowing. Court documents indicated that Tyler was the one to call emergency services the day his brother stopped breathing. Investigators uncovered evidence showing that just before the call, he had texted their father, mentioning Gavin’s deteriorating condition. Surveillance footage captured Tyler making several trips to a shed in the family yard prior to the emergency call; these trips were reportedly an attempt to hide the family’s surveillance equipment.

Evidence obtained during the investigation showed that Tyler, along with their father Shane Peterson and stepmother Nichole Scott, had been monitoring Gavin through cameras while he was confined in a bare room for most of the day. The room was described as devoid of furnishings, lacking a rug or bed, and was equipped with a mechanism that prevented Gavin from leaving.

Further probing revealed disturbing images on Nichole Scott’s phone, portraying Gavin in a severely neglected state. Text messages exchanged among Tyler, his father, and stepmother indicated a collective awareness and discussion of the abuse, sometimes referring to Gavin in derogatory terms.

While Tyler’s father and stepmother had already been sentenced for their part in the horrific circumstances leading to Gavin’s death, Tyler’s fate was held in abeyance for a year as his defence attorneys argued that he was neurodivergent and had also suffered at the hands of his parents. During the sentencing hearing, his mother implored the court to consider allowing him to receive treatment outside of prison, insisting that he would not receive the supportive environment he needed while incarcerated.

However, prosecutors portrayed Tyler as a willing participant in the abuse, describing him as having engaged in acts of violence against his brother without remorse. The presiding judge, Camille Neider, expressed the difficulty of the case, revealing that it was one of the most challenging she had encountered in her three-decade career.

Judge Neider stated, “You had an opportunity to not engage in the behaviour that you have engaged in. You were an active participant since 2020. There’s no doubt about all of that,” before delivering her sentence. Tyler Peterson was sentenced to a term of five years to life for child abuse homicide, alongside two additional sentences of one to 15 years each for aggravated child abuse and obstruction of justice. These sentences will run concurrently, with Tyler receiving credit for 246 days already served. Under this arrangement, he could potentially be released within five years.

Currently, Tyler’s legal representation has not responded to requests for comments regarding the case. The tragic death of Gavin Peterson has reignited discussions surrounding child welfare and the systems in place to protect vulnerable children from abuse, calling attention to the urgent need for vigilance and intervention when signs of neglect and harm are evident.
