A California mother, Maya Hernandez, is currently on trial, facing charges of second-degree murder, involuntary manslaughter, and child cruelty in connection with the death of her 1-year-old son, Amillio Gutierrez. The tragic incident occurred on June 29 in Bakersfield, California, where authorities allege that Hernandez left her two young sons, including Amillio and a 2-year-old, strapped in their car seats inside a hot car for two hours.

According to reports from Court TV, KGET, and KERO-TV, Hernandez was said to have gone to a med spa to receive a lip filler injection while her children were left unattended in the vehicle. Court documents indicate that she left the air conditioner set to 60 degrees before leaving the car.

Upon her return, Hernandez found Amillio unresponsive, and despite efforts to save him, he was pronounced dead with a body temperature of 107 degrees. Fortunately, his brother survived the ordeal. The trial proceedings for Hernandez began on December 8, with prosecutors arguing that although her cosmetic procedure only took 15 to 20 minutes, she failed to check on her children during the two-hour timeframe she was away.
It was revealed that the car’s air conditioner automatically shuts off after running for more than an hour if not manually restarted. Prior to her appointment, Hernandez had inquired with the spa about bringing her children inside, to which she received a response allowing them to wait in the waiting room. However, she decided to leave them in the car despite this option.
Hernandez purportedly told the police that she received a response from the spa but chose to leave her children in the vehicle regardless. Her defense attorney contested the second-degree murder charge during the court proceedings, as reported by Court TV. Amidst the trial, a GoFundMe campaign was initiated by the boy’s aunt, requesting donations to facilitate bringing Amillio home for a proper funeral.
The fundraiser highlighted the devastating loss and impact on the family, expressing the love and heartbreak felt for Amillio. The community was shattered by the news that they would never see his smile again, or witness the bond between the two brothers. The unimaginable tragedy has sparked outrage and disbelief within the local community.
The case serves as a stark reminder of the dangers of leaving children unattended in hot vehicles, especially during extreme weather conditions. It also raises questions about parental responsibility and the prioritization of personal activities over the well-being of young children. The trial will continue as the court seeks to determine the extent of Hernandez’s negligence and accountability in the untimely death of Amillio Gutierrez.
As the legal proceedings unfold, the tragic story of Maya Hernandez and her 1-year-old son serves as a cautionary tale, prompting reflection on the importance of child safety and the consequences of parental actions. The community mourns the loss of a young life, hoping for justice to prevail in the pursuit of accountability for this heartbreaking incident.
